Are You a Candidate for a Flat-fee Uncontested Divorce?

An uncontested divorce makes sense for couples who can communicate effectively and agree on the terms of their divorce without court intervention. It's a quicker and typically less expensive route, with fewer court appearances and less emotional stress.

A divorce lawyer can be incredibly helpful in an uncontested divorce, whether you start out in total agreement or have to work your way through to one. Our attorney can provide legal advice, protect your rights, help draft the divorce agreement, and guide you through court.

Fee Schedule for Non-Litigation Divorce Cases:

  • Simple Divorce starting at $4,500 plus expenses - Simple divorces are uncomplicated and easy.  The parties agree on almost all of the terms of child custody, child support and health insurance for the children and the division of only a few community assets.
  • Moderately Complicated Divorce starting  at $7,500.00 plus expenses - Moderately complicated divorces means that there are some minor issues related to child custody, child support or health insurance for the children and there  may be more community assets to divide, or those that require additional documents to transfer.
  • Complex Divorce starting at $10,000.00 - Complex divorce means those divorces that include more unusual child custody terms, like a non-standard possession schedule, child support for disabled children, deviation from child support guidelines or health insurance for the children and may include the division of small business assets, spousal support, separate property of one or both parties, division of stock or other securities, etc.
  • Litigation Divorce Cases - Petitt Family Law does not offer flat fees for litigation cases, but we do offer other fee structures to accommodate cases that require litigation. Contact us today to discuss how we can best be of service to you in this area!

McKinney Uncontested Divorce Lawyer

Divorce generally involves countless decisions about how to disentangle two lives intimately entwined physically, psychologically, financially, as parents, and in many other ways. This process can be painful, uncertain, and highly stressful. Leaving all the decisions up to a judge in a family court can lead to even more upset and dissatisfaction if you believe the results are unfair or inappropriate.

Resolving the decisions between you and your spouse outside of court can be the fastest, least expensive, and least stressful way to achieve a Texas divorce. This is called an “uncontested” divorce. This means that you and your spouse agree on all issues related to the termination of your marriage.

At Petitt Family Law, our experienced divorce lawyer can help you through the process of uncontested divorce from start to finish. Attorney Melody Petitt is adept at assisting clients to resolve the process through negotiation, mediation, and collaborative divorce

In some cases, you and your spouse may already have agreed on terms, especially in more straightforward cases that do not involve complex property and child-related issues or those where the split is amicable. In others, negotiation with the help of Ms. Petitt may resolve issues entirely prior to the formal filing of an uncontested divorce petition.

Our firm has been exclusively devoted to Texas family law for years. We can help smooth the way, from skilled negotiation to filing documents, having them formally served to the other party, and overseeing the entire process through to its conclusion.

Uncontested Divorce in Texas

In an uncontested divorce, spouses must come to a mutual agreement on several key issues, including:

The term "no-fault" divorce is essential to understand in this context. Texas is a no-fault divorce state, meaning you don’t have to prove fault, such as adultery or cruelty, to file for divorce. Instead, you can cite insupportable differences, which make uncontested divorces significantly more straightforward. Without the need for court hearings to prove fault, the process can move forward much faster.

The Process

The process of an uncontested divorce in Texas generally involves several steps. First, Texas residency must be established. At least one spouse must have lived in Texas for at least six months and in the county where the divorce is being filed for at least 90 days.

Next, you must file a divorce petition outlining the grounds for divorce and any other issues that must be addressed. If these issues have already been agreed upon, you will still be subject to a mandatory 60-day waiting period from the date the petition is filed before a judge can grant the divorce.

The divorce will be finalized after the waiting period if all issues are agreed upon. The judge will review and approve the agreement, issuing a final divorce decree.

Getting an uncontested divorce without the cooperation of your spouse can be challenging, depending on the circumstances. If your spouse fails to answer after being served with divorce papers, the divorce will go into a default judgment. This means the court will hear only your side of the story. However, the judge retains the authority to ensure the final decree is legal and fair.

If your spouse responds to the divorce paperwork by disagreeing with your proposed terms, the process may become a contested divorce, which often requires more time and resources. You still can engage in negotiations and other alternative dispute resolution methods to resolve the matter without litigation.

"Melody was easy to work with, listened to what I had to say, and helped me navigate a complicated divorce."
Melody was easy to work with, listened to what I had to say, and helped me navigate a complicated divorce. Her knowledge of the law made it easy to feel confident in our case. She was very professional and could not have been more thorough. I would highly recommend her to anyone looking for a great attorney who is willing to fight for you.

"Melody and Stacy are a dynamic pair that you can trust to have your best interests in mind always."
Responsive, efficient, so knowledgeable about the law and what you need to get through the process. Melody and Stacy are a dynamic pair that you can trust to have your best interests in mind always. Love them.
    - Kayti
"Amazing results. My only regret is not hiring her initially several years ago."

Melody exemplifies everything that I needed in an attorney. She followed through on every aspect of what she said she would do. Along the way, she always kept my interests in mind when following up with the courts and giving me closure. All this in just a few short weeks before closing out the 2020 year during a pandemic.

In my previous experiences, I’ve always had to chase down my attorney or come up with the solutions on my own. Melody was the exact opposite of that. Replies were very timely, and she came up with solutions prior to discussing with me with any setbacks that would come up.

My only regret is not hiring her initially several years ago.

"Melody is the attorney who took the bull by the horns."

You don’t know what you don’t know. However, you do know when something is not working out. With that said, I went through a couple of attorneys before being represented by Melody Petitt and that made all the difference.

I will start off saying that the divorce process is like a game. And the law is the rule book, which is a constant that does not change. Where the game gets interesting are the players involved, petitioner, respondent and legal team. Every case is unique, yet some attorneys approach the process as if it’s all the same. However, in my case, we were dealing with a high conflict personality; and, it cannot be taken lightly. Unlike my prior attorneys, Melody jumped on my case and took the time to really understand my situation and what we were dealing with. She took the time to educate me on the law and how it applied in my situation, whether it was something I wanted to hear or not. The law is the law. She knew how to deal with the opposing party. Strategy was the key, and she was prepared for anything. She earned my trust and with that trust, she help make this process tolerable. Most importantly, she was able to get my case wrapped up in a timely manner with a desirable outcome. An outcome that would not have been possible otherwise. I highly recommend Melody Petitt.

    "Melody saved my case."
When Melody took over my case, it was going nowhere, the previous attorney had done nothing for months but allow opposing counsel to stall, allowing my case to become dormant, luckily that attorney left the firm. When Melody took over she immediately began filing motions, requesting documents that previously had been denied. The outcome of my case was not all I’d hoped for, but Melody made sure I was able to maximize and make the best out of a bad situation. She was always honest, forthright, and meticulous in her handling of the case. She even pushed for the firm to credit my account for work that the previous attorney had not completed. If you want integrity, honesty, and hard work, definitely hire Melody Petitt as your counsel.

Melody and her staff was was communicative throughout the process. You will not find a better attorney than Melody Petitt!
